Screening must go through – if necessary via Charter

WILLEMSTAD — In a letter dated October 26th to the head of the Intelligence Service Edsel Gumbs, Governor Frits Goedgedrag emphasized that he sets great store by proceeding with the screening procedure and that he confirms his verbal request to complete the factual investigation as quickly as possible – if necessary via article 43 section two of the Charter for the Kingdom of the Netherlands.

Article 43, section 1 states that each of the countries arrange for the realization of the fundamental human rights and freedoms, the legal security, and good governance. Section 2 states: "Guaranteeing these rights, freedoms, legal security and good governance is an affair of the Kingdom."
In the letter, Goedgedrag also states that he spoke with Premier Gerrit Schotte on October 7th last and that it was concluded during this conversation that the intelligence service was not able to perform a complete screening on all candidate members of government for lack of time, that Gumbs had also informed the political leaders of the three political parties forming the government coalition, and indicated he would continue with the factual investigation.
However, on the day after the Governor’s letter, therefore on October 27th, Schotte verbally refused Gumbs access to the department rooms, department premises and the work. In a letter of October 27th, presented to Gumbs on October 28th, the Premier confirmed this decision in writing and simultaneously informed Gumbs that he could no longer maintain his position as former head of the intelligence service. Schotte further informed him that he and his colleague of Justice would not recommend Gumbs for the position of Head of Intelligence Service Curaçao.
On that same day, October 28th, the Premier appointed the former Lieutenant Governor of the island-territory Curaçao – Lisa Dindial – as interim head of Intelligence Service Curaçao.
On September 29th, the interim Governor of the Netherlands Antilles Adèle van der Pluijm-Vrede – within the framework of the National decision of February 10th 2010 regarding the guidelines for the appointment of ministers and state secretaries – requested the Attorney General and Gumbs to conduct a security check as well as a security investigation into the candidate ministers of the new country Curaçao.
In a letter of October 4th, Gumbs informed the party leaders of MFK (Schotte), PS (Helmin Wiels) and the MAN (Charles Cooper) about the Governor’s request to conduct a security investigation into the candidate ministers. On that same day, a conversation took place between Gumbs and the three party leaders, in which Gumbs explained the procedure of the security investigation once again. With that, he also indicated that the candidate ministers had to submit a ‘Status of Particulars’.
In another letter from October 4th, Gumbs wrote the Attorney General that he still hadn’t received a curriculum vitae and a status of particulars from the candidate ministers, that the security investigations would take at least three weeks and therefore not be ready before October 10th.
On 10-10-’10, the country Netherlands Antilles was dismantled and Curaçao acquired the status of country within the Kingdom. The current government was installed on that day as well.

Gumbs’ lawyer, Melrose Bloem, states that Edsel Gumbs returned to work today. She is not aware of reports that Gumbs was refused access again. "I can confirm that Gumbs went to work this morning. I have not had any contact with him, nor have I heard that he was refused access. I spoke with the lawyer of the country yesterday and this matter was not mentioned. If there is something, then I should be informed" according to Bloem.
