In the context of the criminal investigation against Mr Tromp private, the Prosecution on 6 October. Conducted a search at the Central Bank of Curaçao and Sint Maarten ( “the Bank”), at which also many data seized that fall under the statutory duty of confidentiality to the Bank and not the Mr. Tromp private.
Under the law of search and seizure prior consent of the Joint Court of Justice required by the Bank. The legislature has made this demand, considering, inter alia, the supervisory function of the Bank and to protect the confidentiality of information provided to the Bank, including that of supervised financial institutions. The present search and seizure found in the opinion of the Bank place without the legally required permission and against the Bank object.
The Bank considers it, for future cases, given the importance of the statutory duty of confidentiality, appropriate that the judge clarity is obtained on the legal requirements of a search and seizure at the Bank. For this reason, the Bank has complained to the Court of First Instance. This complaint is expected on 31 October a.s. be heard by the Court.
The Bank stresses that, taking into account its secrecy, is cooperating fully with the criminal investigation against Mr Tromp in private.
