Ministry VROMI warns Strict Enforcement of Building Ordinance

The Minister of Public Housing, Spatial Planning, Environment and Infrastructure (VROMI) hereby informs the public that strict enforcement will be implemented with regard to compliance of the Building ordinance and the conditions of issued building permits.
In accordance with Article 7 of the Building Ordinance, it is prohibited to erect a building or partially renovate a building without complying with the conditions as stated in the Building Ordinance or the Building Decree, without a building permit or contrary to the conditions of the issued building permit.
Please be aware that specifically the following general building permit conditions are most relevant:
– The building permit, including approved drawing must be kept on the building site;
– The building permit must be posted visibly on the building site;
– Written notice must be given to the Inspection Department 48 hours before commencement of any critical phase of the construction, such as pouring of concrete.
Any transgression of Article 7 of the Building ordinance will be punished with a fine of NAF 500,-.
Before issuing this fine, the Inspection Department of the Ministry of VROMI will inform the stakeholder by means of a warning letter about the illegal situation, and the stakeholder will be allowed to see to it that the illegal situation is redressed.
Additionally the Minister of VROMI is authorized (Article 64 Building ordinance) to remove any illegal building construction or prevent any illegal building activity at the expense of the transgressor.
